ASSEMBLY: GOVERNOR BARASA MUST SAY NO TO ODM BULLIES.
OPINION By James Kwoma.
The alleged changes at the Kakamega County Assembly by the ODM Party’s Central Committee are surprising, as the party's constitution provides no provision for the committee to enact such changes.
However, they cease to be surprising when viewed as wishful thoughts of Sifuna and his group of anarchists, whose primary aim is to frustrate Governor Barasa's standing within the party and divert attention from his sights on Service Delivery, with the hope that their Anti-development Elsie Muhanda can fool her way to the Governor's office.
First and foremost, Governor Fernandes Barasa is the head of the Executive arm of the Kakamega County Government, of which the County Assembly is party of. However, as outlined in Chapter 11 of the 2010 Constitution—something we expect Sifuna, as a lawyer, to understand—the County Assembly operates independently of the Executive. No reasonable Kenyan, especially a Kenya School of Law graduate, can hold the head of the Executive accountable for issues within the Assembly.
KAKAMEGA Assembly MARJORITY leader and Marama Central MCA Hon. Philipo Maina. Some ODM's CMC members are leading a coup to remove him against the law.
Let's examine the situation. Hon. Sifuna, a Senator and lawyer who came into government under the 2010 Kenyan Constitution, under the guise of the ODM central committee, has directed the Speaker of the County Assembly, also a lawyer, to replace Majority Leader Hon. Philip Maina with Hon. Geoffrey Ondiro. This directive goes against court orders that have stopped the Speaker from implementing any changes. Despite the differing views of the two lawyers on the court orders, the one adhering to the court's directives is clearly correct. That, anyone can tell!
What are the MCAs saying in all this? As the manufactured conflict continues, it’s important to understand their stance. The MCAs have expressed their support for Hon. Philip Maina. So why is the Nairobi Senator, who may not fully grasp Kakamega's needs, impose someone on them? MCAs represent the people, and the wishes of Kakamega people must be respected.
It's safe to say that Sifuna and his associates are attempting to replicate the unfoldings in Meru County in Kakamega, even if it hurts the County.
