A five-judge bench of the constitutional court on Thursday poked holes in the Building Bridges Initiative sponsored constitution amendment process. In a move seen to defend the constitution and sovereignty of the people of Kenya, the judges shredded the process to the extent of terming the BBI Steering Committee unconstitutional. Judges Prof Joel Ngugi, George Odunga, Jairus Ngaah, Teresia Matheka and Chacha Mwita said President Uhuru Kenyatta does not have the power to directly initiate constitutional amendment under the law since parliament is the only organ with that power. If that is allowed it will mean he would be granted the role of promoter and referee, the judges noted. He can however through the AG use Parliament to initiate the process, they said. “It is our finding that popular initiative is a power reserved for Wanjiku neither the president or any other state organ can utilize article 257 to amend the constitution,” said the judges. The MP who intends to vie as Kakamega Governor in 2022 said this at the funeral of Former first Matungu MP the late Joseph Wamukoya on Monday before a charged crowd. Peter Nabulindo launched a charm offensive on his detractors in the March by election. Speaking yesterday on the sidelines of a meeting with the four ODM elected MCAs in Matungu, the legislator said it was time to heal the wounds. None of the five elected MCAs Oduor Lininus, Mayoni, Osanga Bonface, Khalaba Godliver Omondi, Kholera George Mukodo, Namamali and  Harry Shikuku of Koyonzo supported the MP.  The MCAs campaigned for the March loser ODM's David Were with the back up of Kakamega Governor Whycliffe Oparanya who is the Deputy Party leader and lost to ANC's Hon Nabulindo.  At the meeting the MCAs affirmed their commitment in support of the MP and his agenda for the Constituency.  HON Boniface Osanga went on to dismiss the election petition filed by his party terming it as still birth.  The MCAs

FORMER MATUNGU MP DIES WITH NO LEGACY

Story By Calvin Osundwa in Matungu.  Former Matungu Member of Parliament Joseph Wamukoya  died this morning at Life Care hospital in Bungoma Dr. Wamukoya served as the first MP of the constituency between 1997 and 2002. He was elected on a Kanu ticket. The family said the former MP has been ailing for a long time and has occasionally been receiving treatment at a Bungoma hospital. The late MP’s widow Elizabeth Wamukoya said her husband passed on at home early this morning. "The MP has been sick for years and today he rested peacefully at our home," she said. Wamukoya was born in Marinda village of Matungu in 1942. He served in late President Daniel Moi’s government when he was appointed assistant minister in the Ministry of Lands and Settlement in June 2001. Before venturing into politics Wamukoya was a lecturer at the University of Nairobi teaching veterinary services. He also taught at the Michigan State University in the USA. He was later recalled to Kenya afte
