By Joel Eshikumo.
THE Employment and Labour Relations Court in Kisumu has overturned the appointment of Mr. Wesa P. Malack as the Executive Secretary Kenya National Union of Teachers (KNUT) Mumias Branch.
In an application dated 14/8/2020, Mr. John Wesonga Lutta had moved to court to challenge his ousture by KNUT Secretary General Honourable Wilson Sosion from office.
In cause number 60 of 2020, the claimant moved to sue Mr. Wesa P. M. Meshack the purported Ag KNUT Executive Secretary Mumias Branch, The registrar of Trade unions and KNUT national office who were lined up as respondents.
Mr. Wesonga the longest serving Executive secretary had in the application termed the action by Hon Sosion to remove his as "I lawful and unfair" since laws guiding suspension of any Executive Secretary were not followed.
The firebrand Mumias Branch Executive Secretary who is in line to succeed Mr. Omucheni as the National Chairman KNUT sought orders restraining the Registrar of Trade Unions from effecting the purported changes.
Giving the orders, Justice Matthews N. Nduma in his judgment ordered the Ragistraa not to effect the changes at the Branch prior to 21/7/2020 and that the status quo be maintained.
KNUT National office was also ordered to respect the position and status of the officials og Mumias Branch prior to the purported changes by Mr. Sosion.
Basically this means John Wesonga remains the Mumias Branch executive secretary untill a casevchallanging his removal is heard and determined. He was removed from office under unclear circumstances.
