I WAS FRAMED SAYS KAKAMEGA MINISTER

A Kakamega government minister arrested by police last Friday reportedly having fun with a minor at a popular hotel in Bungoma town has accused the police for allegedly setting him up, recording a video of the incident and uploading it on social media platforms to scandalize him.
Robert Kundu Makhanu yesterday reported to his new station at the lands, physical planning and urban development offices for the hand over exercise and later told the People daily on phone that he was framed for personal difference with a police officer in Bungoma.
“You know I’m a government minister, that issue is being handled by the legal department of the county. You can get details there.” he said in response about his arrest and eventual discharge by a Bungoma court last Tuesday
Kakamega county attorney Moses Sande said the minister was charged with breaking curfew law but the prosecution could not proceed due to lack of sufficient evidence. “We’ve now advised him to sue the police for wrongful arrest and confinement as well as character assassination.”
Sande said, “He said he was not with the purported girl, that the girl was planted on him by officers. That’s why the charge sheet did not include the woman or worse if at all he was having fun with a minor, the charge would be sexual in nature”

Bungoma county police commandant Dr. Musyoki Mutungi urged Makhanu to bring it on if he believes the police erred in arresting him. He said police might have erred in preferring a defective charge on the right suspect.
But Sande claimed a personal vendetta over land in Likuyani between the minister and one of the police officers engineered his arrest as they disregarded exemption letters indicating he is permitted to give essential services.
“At first they argued that he was outside beyond the curfew hours…then it changed to failing to observe social distancing, They forced him to his hotel room and when they returned, the young woman purported to be his friend was standing there in the basement,” Sande claims in his defense.
On Tuesday Bungoma south police Commandant Wilson Nanga said Makhanu’s file was referred to the Mutungi for direction after the prosecution flagged down the file citing its failure to meet the legal threshold to sustain a charge
The minister was freed last Saturday on a police cash bail of Sh3,000 after spending a night at the Bungoma police station cells. Yesterday the police remained vague on the whereabouts of the alleged minor.
