KAKAMEGA SERVICE BOARD UNDER SIEGE - As fresh bid to kick it out is received by Assembly.
A Petition to remove the six members of the Kakamega Public Service Board was yesterday received by the Assembly. We can exclusively reveal.
The petitioner Dennis Duncan Muhanda wants the Assembly to consider kicking out the County employment body on a myriad of violations.
The resident of Mahiakalo who has lodged the Petition pursuant to the provisions of Article 38 of the constitution section 5 of the county government Act.
The six individuals tagetted are Chairperson Catherine Raini Omweno, John Ambrose Wanyama, Stanly Amwayi Were, Joel Amukoko Anyera,Sylvia Itembe Otunga and Ralph Wangatia Immam who constitute the CPDB.
The petition exclusively leaked to this blog avers that the law thru section 58(5)(a) confers authority on the Assembly to remove members of the CPSB from office "upon a vote on a motion supported by not less than seventy seven percent of all members.
In his accusations, the petitioner accuses the six together with the former Governor Whycliffe Oparanya of conspiring to dismiss one Catherine Gathoni Otenyo from office as a member of the CPSB despite that she has been legally appointed.
"By so doing, they conspired to exercise powers that they did not have over a fellow member because the law only allows the Assembly to carry out that duty, by so doing they, acting alone and collectively, viopatedall provisions of the constitution" Reads the petition
By this action of the members turning themselves into a quasi-judicial and administrative body, without according the accused a fair hearing, the Assembly should send them home as they are unsuitable to continue serving.
The petition states thereafter " After removing Catherine, they went on to perform her duties in clear and blatant violation of the law between 19th October 2021 upto and untill 7th September 2022 when Catherine wa reinstated back by the Public Service commission".
Between that period, the petitioner claims the board "Spent public money in unnecessary litigation that resulted from their unconstitutional unlawful actions.
It is also claimed on 6thnApril 2923,the CPSB commenced other proceedsand have threatened yet again to begins disciplinary action of removing Catherine in clear breach of the law.
The board is also accused to have been in violation of sec 76 of the County Government Act when they dismissed 47 revenue clerks unprocejuraly a process that led to appeals and the clerks were reinstalled.
Coming back to haunt the Service Board is the employment of six individials individials namely Desterio Wanganya Okumu, Fred Shiami Muka, Geoffrey Aligula Minodi, Thomas Oyolo Omurunga, Tarriq Azziz and Anderson Musungu Amoi in verious positions.
The petitioner says the board employed them clearly knowing they had fraudulent forged and suspected illigal academic papers and thereby even after discovery, declined to commence disciplinary action against the said now infamous "MUKA SIX".
By failing to "ascertain the Educational background and qualifications the petitioner says the board was and is as currently constituted incompetent.
The petitioner goes on to zero in on the Chairperson of the CPSB Catherine Rsini Omweno who he accuses that between October 2022 and January 2023, she messed a county vehicle on personal errands to Nairobi and Ruaraka on personal frolics.
Still on chapter six violation, Stanley Awayi Were a member of the board is accused that he had in the course of duty this year, "solicited and received a bribe from a shortlisted candidate who aspired to be nominated fir possible appointment as County Chief Officer and in that respect, he was arrested and is out on police bond pending further investigation.
It will be interesting to see how the County Assembly handles the petition at the time when there are deep divisions amongst MCAs over Watsapp spats and bar talk that is constituted in allaged disciplinary of some MCAs who are accused of being disrespectful of the Speaker James Namatsi.
